This Privacy Policy explains how Kollabr collects, uses, shares and protects your personal information when you use the Platform, our South African marketplace where Brands buy short-form videos from Creators. We handle personal information in line with the Protection of Personal Information Act 4 of 2013 ("POPIA"), and we are committed to keeping your information safe and using it fairly.
1. Introduction & scope
This policy applies to everyone who uses the Platform — Brands, Creators and visitors — and covers the personal information we process through kollabr.co.za and related services.
For the purposes of POPIA, Kollabr, operated by Lunara Ventures (Company Registration No. 2026/418581/07), is the "responsible party" for the personal information we process. This means we decide why and how your personal information is processed.
Our Information Officer can be contacted at support@kollabr.co.za for any privacy question or to exercise your rights.
2. Personal information we collect
We collect the following categories of personal information, depending on how you use the Platform:
- Account and identity information: your name, email address and password (which we store in hashed form, never in plain text).
- Profile information: for Creators, your bio, content categories and profile or portfolio images; for Brands, your company name, industry and website.
- Content you upload: the Videos and other Content you submit, including any personal information contained in them.
- Transaction records: details of Purchases and Payouts, the Prices and amounts involved, Platform Fees, and the parties to each transaction.
- Payment information: payments are handled by our Payment Partner (TradeSafe). We do not store full card numbers; card data is processed by the Payment Partner. We keep records of transaction status and amounts.
- Technical and usage information: your IP address, device and browser details, log data, and information collected through cookies (see our Cookie Policy).
3. How we use it & the lawful basis under POPIA
We process your personal information only where POPIA allows it — for example because it is necessary to perform our contract with you, to comply with a legal obligation, to pursue our legitimate interests, or with your consent. We use your information to:
- provide and operate the marketplace and your account;
- process Purchases and Payouts and enable transactions between Brands and Creators;
- display Previews and unlock Videos after a completed Purchase;
- keep the Platform secure and prevent fraud and abuse;
- provide customer support and respond to your queries;
- comply with our legal, tax and regulatory obligations;
- send you service messages about your account, transactions and important changes.
4. Sharing & recipients
We share personal information only where it is necessary and lawful, with:
- The other party to a transaction (a Brand or Creator), to the extent needed to complete a Brief, Purchase or Payout;
- Our Payment Partner (TradeSafe), to process payments and Payouts;
- Hosting, IT, infrastructure and email service providers who act as our "operators" (processors) and only handle data on our instructions;
- Authorities, regulators or courts where we are legally required to disclose information.
We do not sell your personal information.
5. Cross-border transfers
Some of our operators (for example hosting or email providers) may process personal information outside South Africa. Where this happens, we take steps required by section 72 of POPIA — for example ensuring the recipient is subject to laws, binding rules or contractual safeguards that provide an adequate level of protection comparable to POPIA.
6. Security safeguards
We apply reasonable technical and organisational measures to protect personal information against loss, unauthorised access, alteration or disclosure — including encryption in transit, hashed passwords, access controls and trusted service providers.
If a security compromise affects your personal information, we will notify you and the Information Regulator as required by section 22 of POPIA.
7. Retention
We keep personal information only for as long as it is necessary for the purposes set out in this policy, or for as long as the law requires us to (for example for tax, accounting or dispute-resolution purposes). When information is no longer needed, we securely delete, destroy or de-identify it.
8. Your POPIA rights
Subject to POPIA, you have the right to:
- access the personal information we hold about you;
- request correction of inaccurate or incomplete information;
- request deletion or destruction of your information where appropriate;
- object, on reasonable grounds, to the processing of your information;
- withdraw consent where we rely on it (this will not affect processing done before withdrawal);
- lodge a complaint with the Information Regulator.
To exercise any of these rights, email support@kollabr.co.za. We may need to verify your identity before acting on a request.
9. The Information Regulator
If you are unhappy with how we handle your personal information, you have the right to complain to the body that oversees POPIA:
- Information Regulator (South Africa)
- JD House, 27 Stiemens Street, Braamfontein, Johannesburg
- General enquiries: enquiries@inforegulator.org.za
- POPIA complaints: POPIAComplaints@inforegulator.org.za
10. Cookies
We use cookies and similar technologies to operate the Platform, keep you logged in and remember your preferences. For full details, please see our Cookie Policy.
11. Children
The Platform is not intended for anyone under the age of 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us at support@kollabr.co.za so we can remove it.
12. Changes to this policy & contact
We may update this Privacy Policy from time to time. If we make material changes, we will take reasonable steps to notify you. For any privacy question, or to contact our Information Officer, email support@kollabr.co.za.
