This Acceptable Use Policy explains what you may and may not do on Kollabr (the “Platform”), the South African online marketplace at kollabr.co.za where Brands buy short-form videos from Creators. It is designed to keep the marketplace safe, lawful and fair for everyone. Kollabr is operated by Lunara Ventures (Company Registration No. 2026/418581/07) (“Kollabr”, “we”, “us”, “our”), incorporated in the Republic of South Africa.
1. Scope
This policy applies to everyone who uses the Platform — Brands (Buyers), Creators (Sellers) and visitors — and to all content and activity on it, including Videos, Previews, messages, reviews and account information.
This policy forms part of, and must be read with, our Terms of Service, our Creator Agreement & Content Licence and our Brand / Advertiser Terms. Breaking this policy is a breach of those agreements. Capitalised terms have the meanings given to them in the Terms of Service.
2. Prohibited content
You must not upload, submit, share, display or otherwise make available any content that:
- is unlawful, or promotes or facilitates unlawful activity;
- infringes any third party's intellectual property rights (such as copyright, trademarks or design rights), privacy rights, or publicity (image/likeness) rights;
- you do not own or for which you do not hold all necessary rights, licences, consents and releases — including releases from identifiable people and permissions for any property, locations, products or brands shown;
- is sexual content involving minors, or any child sexual abuse material (CSAM). We have zero tolerance for this. Such content will be removed immediately and reported to the South African Police Service and any other relevant authorities;
- constitutes hate speech, harassment, bullying, threats, or incitement to violence or discrimination against any person or group;
- is defamatory or maliciously false about any person or organisation;
- contains deceptive, false or misleading advertising claims;
- contains or links to malware, viruses, or other harmful or malicious code;
- discloses the personal information of others without their consent, contrary to the Protection of Personal Information Act, 2013 (Act 4 of 2013) (POPIA); or
- breaches the advertising standards and consumer-protection rules of the Consumer Protection Act, 2008 (Act 68 of 2008) (CPA), including its rules against misleading or unfair advertising.
3. Prohibited conduct
You must not, and must not attempt to or help anyone else to:
- download, capture, screen-record, scrape, copy or otherwise obtain a Video before a Purchase has been completed;
- circumvent, disable, remove or interfere with the Preview watermark or any download or copy protections;
- reverse-engineer, decompile, probe, overload, disrupt or otherwise attack the Platform or its security or infrastructure;
- commit fraud, abuse chargebacks, or use stolen or unauthorised payment methods;
- transact, communicate to transact, or pay off-platform in order to avoid the Platform Fee or otherwise circumvent the Platform's payment process;
- create fake or duplicate accounts, post fake reviews, or otherwise manipulate ratings, rankings or reviews;
- harvest, collect or store other users' data or personal information without authorisation;
- send spam or unsolicited or bulk communications; or
- impersonate any person, brand or organisation, or misrepresent your affiliation with anyone.
4. Enforcement & consequences
We may take any action we consider appropriate and proportionate where this policy is broken, or where we reasonably suspect it has been. Depending on the seriousness of the breach, this may include:
- removing or disabling access to content or Previews;
- issuing a warning;
- suspending or permanently terminating an account;
- withholding or freezing funds or Payouts where we reasonably suspect fraud, chargeback abuse or other unlawful conduct, pending investigation; and
- reporting conduct to the South African Police Service, regulators or other relevant authorities, and cooperating with their investigations.
We may act with or without prior notice depending on the circumstances, and our taking (or not taking) action in one case does not waive our right to act in another. Enforcement under this policy is without prejudice to any other rights or remedies we have under the Terms of Service or the law.
5. Reporting abuse
If you believe content or conduct on the Platform breaches this policy, please report it to us at support@kollabr.co.za. To help us act quickly, please include:
- a link to, or clear description of, the content, account or Brief involved;
- what you believe is wrong and which part of this policy it breaches;
- any evidence that supports your report (such as screenshots); and
- if you are claiming an infringement of your rights, enough detail to identify the rights and confirm you are the rights-holder or are authorised to act for them.
We will review valid reports in good faith. Submitting a knowingly false or abusive report is itself a breach of this policy.
